1. Premise

The offer and sale of products on the www.grimandicalzature.it website are governed by what is set out in this section and in particular by point 2. "Sales Contract". Products purchased on www.grimandicalzature.it are sold directly by Grimandi calzature snc of Grimandi Mario & C. with registered office in Via Roma 1 – 40052 Baricella (BO), registered in the Company Register of Bologna (BO) Italy with n° 03770370371 and R.E.A. BO No. 313953. Payments, refunds and all monetary transactions generated by purchases and returns are received, sent and processed by the company Grimandi calzature snc di Grimandi Mario & C. with registered office in Via Roma 1 – 40052 Baricella (BO). By placing an order you are making an offer to purchase a product by accepting the "Contract of Sale" which is described in point 2 of this page. We remind you that Grimandi calzature snc on the site www.grimandicalzature.it carries out its e-commerce activity exclusively towards its users who are "Final Consumers": with this definition we refer to a natural person who acts for purposes unrelated to his commercial, entrepreneurial or professional activity, if any. The texts present in other languages therefore have only an accessory character with respect to those in Italian.

2. Contract of Sale

When the user (hereinafter also referred to as "customer") places an order, he automatically accepts the Premise of point "1" of these Terms of Sale and the following Contract of Sale with Grimandi calzature snc di Grimandi Mario e C. 2.1. Mandatory Requirements

  • Own and provide a valid email address
  • Possess the necessary requirements to be able to enter into legally binding contracts
  • Possess a valid credit card for payment belonging to the Visa or MasterCard circuit or a verified PayPal account, or a bank account..

2.2. Price and availability

All orders are subject to availability and order price confirmation: Merchandise for sale at www.grimandicalzature.it is also and simultaneously on sale in the physical store (retail business) of Grimandi calzature and therefore there may be the remote possibility that the purchase of the same product is completed simultaneously both online and in the physical store: in this case Grimandi calzature snc will give precedence to the customer who went to the physical store at that precise moment and is already directed to the cash desk, refunding any payment already sent by the user online in whatever form it took. The refund will be made by crediting the Paypal account of the customer who paid for the goods on www.grimandicalzature.it by canceling the charge on the credit card or by bank transfer if he has chosen this payment option. If the client of www.grimandicalzature.it has chosen cash on delivery, the order will be canceled and the customer notified. In the event of lack of availability of the product, it will be the seller's responsibility to promptly inform the customer of the impossibility of completing the sales contract. Our staff tries to ensure that all details, descriptions and prices appearing on the www.grimandicalzature.it site are accurate but despite this it is possible that errors may occur, above all due to the entry of data into the database with the consequent risk of human error. If we find an error in the price of the products that the customer has ordered, he will be informed as soon as possible and will have the right to choose whether to reconfirm the order at the correct price or cancel it. If we are unable to contact him, we will consider the order canceled. If, following a price change, the customer decides to cancel the order after having already paid for the products, he will receive a full refund. If applicable, the price is inclusive of VAT. Any delivery costs will be added separately and are clearly indicated and included in the "grand total".

2.4. Purchase procedure

The shopping cart represents a virtual location of the user account or of the general customer where the chosen items are stored and ready to be paid for. The products can always be added to the cart, in any position of the site they are displayed (navigation by category, homepage, related products, etc.) The products can be added to the cart either by a user registered on the www.grimandicalzature.it site whether you decide to proceed with the purchase as a guest. 3. Guarantees

The products sold are guaranteed by Grimandi footwear which carries out the retail sales activity in its physical store or online through the www.grimandicalzature.it website. Only top quality branded products are offered for sale which are purchased directly from the seller from manufacturers of fashion brands, resellers and official distributors, carefully selected on the basis of the high quality standards required by us. Grimandi footwear is therefore the official authorized dealer of all the brands sold on its website.

3.1. Legal guarantee for the consumer

All products marketed enjoy the legal guarantee of conformity provided for in articles 128 et seq. of the Consumer Code which covers any lack of conformity of the items purchased, existing at the time of delivery and which occur within 2 years of delivery. Any defects or damage caused by accidental events or by the responsibility of the Consumer Customer for use of the products that do not comply with their intended use, or the effect of normal wear and tear, are excluded from the lack of conformity and, therefore, from the legal guarantee. To benefit from this guarantee, the Consumer Customer must report the lack of conformity with a communication addressed to the seller indicating the defects and faults found. Following this communication, the Consumer Customer may ask the seller, at his choice, to repair the good or replace it, without charge in both cases, unless the requested remedy is impossible or imposes disproportionate costs on the seller. It is also specified that the Consumer Customer has no right to terminate the contract if the lack of conformity is only minor. The above legal guarantee is valid for a maximum period of two years from the delivery of the product. Beyond this term, therefore, Grimandi calzature will not be responsible for the lack of conformity found. In case of replacement or repair of the product, the terms of the warranty relating to the product given in replacement or resulting from the repair, are the same as the original product. Therefore, the two-year total duration of the legal guarantee will in any case start from the delivery of the original product. In any case, for the regulation of the legal guarantee, reference is made to the rules of the Consumer Code referred to in articles 128 and following.

3.2. Legal guarantee for non-consumer customers

The non-consumer customer, as defined in art. 3 of the Consumer Code, has the right to make use of the legal guarantee provided for in the Civil Code. This guarantee provides that the non-consumer customer, under penalty of forfeiture, notifies Grimandi footwear of any lack of conformity found in the product purchased within eight days of discovery. The above legal guarantee is valid for a maximum period of twelve months from the delivery of the product. Beyond this term, Grimandi calzature will not be held responsible for the lack of conformity found by the non-consumer customer.

4. Shipping and delivery of products

4.1. Shipping fees

Express shipping in Italy is free, fast, safe and reliable.

4.2. Delivery time

In Italy Delivery takes place on average within 1 working day while it is 2 days for Basilicata, Calabria, Sicily, Sardinia. For some disadvantaged locations an additional day may be required. Shipping costs and times outside Italy are indicated in Shipping and Payments. All orders placed before 14:30 are immediately processed and shipped the same day. Orders placed on Friday afternoon (after 2:30 pm) Saturday, Sunday and holidays are shipped on Monday afternoon or the first working day in case of holidays. Shipments are always and only after receipt of payment and in the case of bank transfer we will wait for the actual credit in currency to our current account and the sending of a transfer receipt will not constitute proof of payment.

4.3. Shipment tracking

At the same time as the shipment, the tracking number will be provided to the Customer via email so that he can follow its progress.

4.4. Delivery and passing of risk

To protect the customer, we only use insured express shipments and it is therefore not possible to request a different courier from those offered by Grimandi footwear. However, any damage to the packaging of the products must be immediately contested by the Customer by affixing a written control reserve on the Courier's proof of delivery. It is understood that, once the delivery document has been signed without any objection, the Customer will no longer be able to make any complaint to Grimandi footwear with reference to the external characteristics of what has been delivered. In the event that the delivery has been accepted with an unauthorized signature or there is evidence of tampering with the package, the customer is requested to immediately report the incident to the courier's local office and contact us by sending an email at the address info@grimandicalzature.it

5. Dispute Resolution

Consumers resident in Europe are hereby informed that pursuant to Regulation 524/2013 the European Commission has set up an online platform that provides an alternative dispute resolution tool. This tool can be used by the European consumer to resolve in a non-judicial way any dispute relating to contracts for the sale of goods and services stipulated online and / or deriving from them. Consequently, if you are a Consumer established in Europe, you can use this platform for the resolution of any dispute arising from the online contract stipulated on this site.
